1. Scope of Service

The terms “the Centre”, “we” and “us” refer to the AALCO Hong Kong Regional Arbitration Centre. The Centre operates and administers the websites and online platforms through which business disputes may be settled by negotiation, mediation, and arbitration (the “Services”).

The terms “you” and “user” refer to all individuals and/or entities accessing the Services. The term “Contents” refers to all or any of the data, text, button icons, forms, links, HTML codes, trademark, software, music, sound, photographs, graphics, still pictures, series of moving pictures, videos, merchandise, products, advertisements, services or any compilation or combination of them that may be found on our websites.

The Centre provides the Services to users, subject to the following terms, which may be updated and revised by us from time to time by posting the revised version at the websites. We hereby reserve the full and unfettered right to the interpretation and implementation of these Terms of Use.

To use the Services, you must be at least 18 years, or, you are under 18 years of age and have your parent’s or guardian’s consent to these terms.

By using our Services or accessing our websites, you accept and agree to be bound by our terms.

All Services together with any new functions or features that augment or enhance the Services currently offered shall, unless explicitly stated otherwise, be subject to our terms. You understand and agree that the Services are provided “AS-IS” and “WHERE-IS” without representation or warranty of any kind and the Centre assumes no responsibility for the deletion, mis-delivery or failure of the provision of any functions of our websites or the delivery of the Services. Our Services may not be available in all geographic locations. Only persons who are permitted by applicable law may use our services. They are required to ensure that they observe all relevant restrictions under the laws or the jurisdiction to which they are bound or located.

Eligibility of any person for the use of our Services is subject to the final determination of the Centre.

The Centre shall not be liable for any failure of any functions of our websites or the delivery of the Services in whole or in part or for your inability to gain access in whole or in part to such functions or Services due to the delay or failure of any communication networks or any party providing such access.

You agree to act responsibly and indemnify, defend and hold harmless the Centre, its affiliates, officers, agents, partners, staff and employees against any and all claims, proceedings, damages, injuries, liabilities arising from (i) your breach of our terms, and/or (ii) your use of the Services.

The Centre reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services with or without notice. You agree that the Centre shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Services.

You may not assign any of your right under these Terms of Use in whole or in part.

Any failure of the Centre to enforce any of these Terms of Use will not constitute a waiver.

These terms and conditions are governed by the laws of Hong Kong.

If any provision of these Terms of Use is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of the remaining provisions.
