2.3 Eligibility criteria for Adjudicators.

Applicants must hold one of the followings:

  1. Membership in HKIA (The Hong Kong Institute of Architects)HKIE (The Hong Kong Institution of Engineers), or HKIS (The Hong Kong Institute of Surveyors).
  2. Registration as an ArchitectProfessional Engineer, or Professional Surveyor.
  3. Valid Practising Certificate issued by the Law Society of Hong Kong or Hong Kong Bar Association.
AdjudicatorNo less than 7 years in contract administration, claims assessment, variation valuation, dispute resolution, or construction litigation; andNo less than 5 years in preparing/assessing contractual claims or dispute resolution in Hong Kong.
Senior AdjudicatorNo less than 12 years in the above fields; andNo less than 10 years in the above fields in Hong Kong.

Applicants must:

  1. Have no conviction by any court for corruption, fraud, conspiracy to defraud, or dishonesty-related offences;
  2. Have no finding of misconduct by a disciplinary tribunal;
  3. Satisfy the AALCO-HKRAC that no prior offence renders them unsuitable.

Successful completion of adjudication training provided by AALCO-HKRAC or those provided by HKIA, HKIE, HKIS or other recognized organisations within 4 years preceding the application.

AALCO-HKRAC delivered the first Adjudicator Training dedicated to the Construction Industry Security of Payment Ordinance (SOPO) Cap 652 in Hong Kong. This program was delivered in April 2025 in collaboration with the HKIA, HKIE, and HKIS. For details, please visit:

3. Training Programmes

In April 2025, AALCO-HKRAC delivered a comprehensive training program designed to equip local professionals to serve as adjudicators under the Construction Industry Security of Payment Ordinance (Cap.652).

Our four-day training program fully covers all modules mandated by the Development Bureau, as specified in Appendix I of the Guidance Notes for Application for Admission to the Register of Nominating Bodies Construction Industry Security of Payment Ordinance (Cap. 652)

While AALCO-HKRAC will deliver adjudicator training periodically, AALCO-HKRAC recognises equivalent training courses provided by HKIA, HKIE, HKIS, and other Adjudicator Nominating Bodies. We welcome applications from all suitably qualified professionals seeking inclusion on our SOPO adjudicator panel.

4. Fees, Expenses and Costs of Adjudication

(I) AALCO-HKRAC Fee Structure

Pursuant to Section 65(1) of Cap. 652, AALCO-HKRAC is entitled to charge a fee for its services (“ANB Fee”). The ANB Fee is determined based on the sum in dispute as set out as of the date on which the Notice of Adjudication is served on the AALCO-HKRAC, according to the following scale:

The ANB Fee may be recalculated by adding the adding the additional set-off amount to the sum of dispute under Article 4 of the Rules.

(II) Adjudicator Fee Structure

The Adjudicator’s Fees are calculated in accordance with the Fee Structure on the date on which the Notice of Adjudication is served on the AALCO-HKRAC and is subject to the capped amount corresponding to the sum in dispute.

** The adjudicator’s fee might exceed the capped amount if the parties have jointly agreed pursuant to Article 15.1.

Subject to Note 2 below, the sum in dispute is calculated based on information available at the time of the Notice of Adjudication is served on the AALCO-HKRAC:

If a payment response was served by the payment response deadline:

  • the claimed amount minus admitted amount (for disputes where admitted amount is less than the claimed amount), plus any unpaid admitted amount (if applicable); or
  • outstanding portion of the admitted amount for payment dispute solely on admitted amount not fully paid by the payment deadline; or

If there is no payment response served by the payment response deadline:

  • the full claimed amount.

For the ANB Fee and capped Adjudicator’s Fee, calculation of the sum in dispute follows Note 1 above but may be re-calculated where Articles 4.3 and 15.2 apply.

When the adjudicator is required to travel to or from Hong Kong for the purposes of adjudication proceedings, the adjudicator shall be entitled to reimbursement equivalent to 50% of the adjudicator’s hourly rate for any time spent traveling.

Adjudicator’s Expenses

The Adjudicator is entitled to reimbursement of expenses in accordance with the AALCO-HKRAC Construction Industry Security of Payment Ordinance Practice Note on Adjudicator’s Fees, Expenses, Costs of the Adjudication.

Per diem allowance

In addition to the payment of adjudicator’s fees, Expenses, Costs of the Adjudication, an adjudicator required to travel outside his or her usual jurisdiction of residence or business for the purpose of a hearing or conference under the Rules shall be paid a flat-rate per diem allowance of HKD 3,000.

This per diem covers the following expenses incurred during such travel:

  • Hotel accommodation (if applicable);
  • Meals and beverages;
  • Laundry, dry cleaning, ironing and other housekeeping services;
  • Inner-city transport (excluding travel to and from an airport or train station);
  • Communication costs (telephone calls, faxes, internet, post, etc.); and

The per diem allowance shall be paid within 14 days following the conclusion of the relevant hearing or conference, upon submission of a travel expense claim.

For the avoidance of doubt, no per diem allowance will be paid in respect of time spent by an adjudicator travelling to or from the relevant destination.

An adjudicator is not required to submit receipt or invoices in order to claim the per diem allowance. Evidence of travel for the purposes of the adjudication is sufficient.

(III) Costs of independent expert, inspection etc.

Where the adjudicator appoints an independent expert, or directs any inspection of a construction site, construction work, or other thing carried out under Section 35(1) of Cap. 652, the costs incurred shall be treated as costs of the adjudication proceedings under Section 54(1)(a)(iii) of Cap.652.

The adjudicator shall promptly notify AALCO-HKRAC when such costs are anticipated. AALCO-HKRAC may then request supplementary deposits to be held in escrow.

5. Nomination & Appointment Process

5.1 Step-by-step guide for nominating/appointing adjudicators.

(a) Contract-Specified Process

  • If the construction contract:
    • Specifies only 1 nominating body → proceed to Initiation of Adjudication.
    • Does not specify a nominating body → Claimant nominates 2 independent nominating bodies.
    • Specifies multiple bodies→ Claimant nominates 2 from the contract-listed bodies.

(b) Respondent’s Selection (5 Working Days)

  • Within 5 working days of receiving the Notice of Adjudication, the Respondent must:
    • Select one nominating body from the Claimant’s list.
    • Serve a written notice on the Claimant.

(c) Default Selection by Claimant (3 Working Days)

  • If the Respondent fails to respond, the Claimant selects one body within 3 working days and notifies the Respondent.

The Claimant submits a Notice of Adjudication to AALCO-HKRAC to commence proceedings.

The selected nominating body must within 7 working days after the date on which the adjudication notice is served on the body:

I. Shortlist Candidates:

    • Identify more than 5 available candidates from its panel, ensuring no conflicts of interest (CoI).

II. Propose Candidates:

    • Submit more than 2 candidates to both parties, including:
      • CVs (highlighting adjudication/arbitration experience in past 3 years);
      • Fees;
      • CoI declarations/disclosures.

III. Party Consultation (2 Working Days):

    • At least 2 working days for parties to raise CoI concerns and indicate preferences.

IV. Final Appointment:

    • Appoint the adjudicator based on:
      • Mutual party preference, or
      • Criteria like relevant experience if preferences differ.

V. Notify Parties:

    • Confirm the appointment in writing to both parties.

VI. Reply Form on Parties’ Concerns on Conflicts of Interest and Order of Preference

  • Templates for adjudication notices, correspondence, and proforma documents.

5.2 Adjudication Rules

  • Code of Conduct for adjudicators.

6. Complaints Mechanism

Procedure for lodging complaints against adjudicators appointed by AALCO-HKRA is as follows:

I. Lodging a Complaint

Any person dissatisfied with the conduct of an adjudicator on an AALCO-HKRAC panel or list may submit a written complaint to the Secretariat at [email protected].

II. Acknowledgement & Referral

  • The Secretariat shall acknowledge receipt within 7 working days.
  • The complaint shall be forwarded to the Panel Selection & Appointments Committee (or a dedicated Adjudicator Complaints Review Committee if AALCO-HKRAC prefers a distinct body).

III. Initial Review

The Committee shall review the complaint and determine whether:
(a) To dismiss it as frivolous, or
(b) To seek comments from the adjudicator and/or other parties to the proceedings.

IV. Seeking Comments

  • If comments are required, the Secretariat shall:
    • Notify the adjudicator and relevant parties of the complaint.
    • Request written responses within 14 days (or a Committee-specified period).
  • All responses shall be forwarded to the Committee without delay.

V. Further Information

The Committee may request additional written comments from the complainant, adjudicator, or parties at its discretion.

VI. Decision & Sanctions

  • After reviewing all materials, the Committee shall decide whether the complaint is established.
  • If established, sanctions may include:

(a) Written warning/censure;
(b) Suspension from AALCO-HKRAC panels/lists;
(c) Removal from panels/lists;
(d) Other measures deemed appropriate.

VII. Confidentiality

All complaint-related documents, information, and decisions shall remain confidential, unless:

  • The complainant and adjudicator agree otherwise; or
  • Disclosure is required by applicable law.

VIII. Committee-Initiated Review

The Committee may proactively review an adjudicator’s listing based on credible information (e.g., misconduct discovered independently) and impose sanctions after allowing the adjudicator an opportunity to comment.

IX. Reasons & Finality

  • The Committee is not obligated to provide reasons for its decisions.
  • All decisions are final and unappealable, subject to mandatory provisions of applicable law.

7. Service & Communication

Methods for Serving Adjudication Notices and Correspondence.

Pursuant to the AALCO-HKRAC Construction Industry Security of Payment Adjudication Rules, the adjudication process commences only once the Notice of Adjudication (Form A) and the ANB Fee are duly received by the AALCO-HKRAC Secretariat.

I. Method of Submission

Claimants must specify in Form A (Notice of Adjudication) whether they request:

  • Electronic service of the Notice to the Respondent(s) via email: [email protected]
  • Physical service (e.g., delivery against receipt, registered post, or courier).

Pursuant to Section 41(a) of the Ordinance, failure to pay the ANB Fee within three (3) working days of AALCO-HKRAC’s receipt of the Notice of Adjudication, AALCO-HKRAC may result in suspension or refusal to appoint an Adjudicator until payment is received.

Payment Methods

Payment may be made by any of the following means.

  1. Cheque
    • Payable to “AALCO Hong Kong Regional Arbitration Centre” in Hong Kong Dollars. 
    • Please note that only cheques drawn on Hong Kong banks are accepted
  2. Bank transfer
    • Please contact AALCO-HKRAC ( [email protected] / +852 2180 0923) prior to payment to confirm the bank account details.
    • All bank charges are borne by the remitting party

III. Next Steps

  • Upon receipt of both the Notice of Adjudication and ANB Fee, AALCO-HKRAC will process the adjudication appointment.
  • The Claimant must submit the Adjudication Submission within One (1) working day of the adjudicator’s appointment.
